General terms and conditions

These terms and conditions apply to all sales and services offered by VEDETTES BAIE DE SEINE (hereinafter referred to as the Seller). Any order, acceptance of a quotation or reservation implies unreserved acceptance of these terms and conditions of sale. They may be updated by the Vendor from time to time.

Definition of the service

The passenger launch offers to transport people within the port of Le Havre. The launch may offer other services on request, subject to obtaining the necessary authorizations.

Tours are guided in French by the boat’s captain.

Order/quotation

All bookings are subject to the Buyer’s option being placed by post or telephone, followed by written confirmation by e-mail or post. In order to confirm this option, the Vendor will send a quotation to the Buyer. This quotation must be returned by the Buyer dated, signed and marked “bon pour accord”, and must be accompanied by a deposit or a copy of the purchase order issued by the Seller. The quotation is valid for one (1) month from the date of dispatch by the Vendor to the Buyer. On receipt of these documents by the Vendor, a booking confirmation is sent by e-mail to the Buyer, blocking the date and time of the desired outing.

Special requests

All special requests for services on or with the vessel will be subject to a feasibility study by the Buyer before a quotation is sent.

Reservations

The Buyer is required to confirm the actual number of passengers booked at least seven (7) days before the date of the service. Should this not be the case, only the last headcount indicated in writing or on the quotation may be taken into account for invoicing purposes.

Deposit

As indicated above, the Buyer is required to pay the Vendor a non-refundable deposit corresponding to 25% of the total amount (including tax) of the service booked. Special case: no deposit is required for outings booked by public institutions. However, the latter must provide a signed copy of the purchase order issued by their purchasing department.

Payment/invoicing

All services are subject to payment in euros.
Payment must be made on site before boarding the ship.
For pre-booked outings, the Purchaser may pay as follows:

  • At the ticket office, on the day of the outing, by cheque, cash, credit card or ANCV vacation vouchers;
  • On receipt of the invoice, by cheque or bank transfer.

Cheques should be made payable to the Vendor: SAS Vedettes Baie de Seine.

Duration/ Tour

The duration of each service is given as an indication to the Buyer when requesting an option. The choice of itinerary is decided by the Vendor at the time of embarkation.

The duration of the service may vary due to external factors (weather conditions, port traffic, etc.).

Boarding

The Buyer must be present for boarding 15 minutes before departure, at the following address: Port de plaisance du Havre -125 boulevard Clémenceau – Digue Charles Olsen – 76600 Le Havre.

Embarkation will take place under the orders of the Seller and in compliance with safety instructions.

In the event of a change of embarkation address, the Seller will notify the Buyer in due time.

Compliance with boarding times is an essential condition for the smooth running of the outing. In the event of the Buyer’s delay, the duration of the tour will be reduced proportionally according to the time of delay. If the Buyer’s delay

is more than 15 minutes later than the embarkation time, the Vendor is entitled not to wait for the late Buyer and to make the ship leave with the other passengers on board. This delay does not entitle the Buyer to any compensation if he fails to show up within the required time.

Security

The buyer is required to remain seated during the visit.

Life jackets are available if necessary.

The Buyer is required to take all necessary measures to ensure safety on board the vessel.

In the event of behavior deemed dangerous and which does not allow the necessary safety conditions to be met on board the ship, the Vendor reserves the right to refuse access to the ship or to disembark any person, without giving rise to any compensation.

This includes, but is not limited to, persons who are under the influence of alcohol or drugs, persons who endanger their own lives or the lives of others, persons who behave in a generally inappropriate manner, and persons who fail to comply with the Vendor’s orders.

Responsibility

The Buyer is responsible for all damage caused by him/her.

The Vendor declines all responsibility for loss or theft of personal effects, as well as for damage to optical and electronic equipment caused by sea spray.

Insurance

The Vendor has taken out a civil liability policy with a solvent insurance company to cover the practice of these activities.

Cancellation

The Vendor must cancel the outing if it is confronted with one or more hazards beyond its control, such as adverse weather conditions, works in the port area, technical problems, etc. This list is not exhaustive.

The Vendor also reserves the right to cancel an outing if the number of passengers to be taken on board is less than fifteen (15).

In the cases described above, it is agreed that the Parties will fix a later date for the cancelled outing, or failing this, the sum of money potentially paid will be returned to the Buyer. The Buyer may not claim any financial compensation.

The Buyer may decide to cancel the scheduled outing. In this case, cancellation charges vary according to the period of notice given. In all cases, the cancellation must be made in writing.

  • Cancellation at least 30 days prior to the booked outing will incur a cancellation fee of 25% of the total amount of the booking;
  • Cancellations made up to 3 days prior to the booked outing will incur a cancellation fee of 50% of the total amount of the booking;
  • Cancellation between two days and the day of the outing, the Buyer must pay the full amount of the reservation.

Finally, in the event of a health crisis, such as a pandemic linked to COVID-19, only ministerial or prefectoral decrees may justify a request to postpone or cancel a visit. In the absence of such orders, visits will be billed as described above.

Complaints

In the event of an incident during the visit, the Buyer must inform the Vendor without delay. Any complaint by the Buyer must be confirmed by registered letter with acknowledgement of receipt within a maximum of fifteen (15) days after the date of the visit. If the Vendor is not notified on site, no claim can be taken into account.

Applicable law and jurisdiction

These GCS are governed by French law.

In the event of a dispute, the Buyer and Seller shall endeavor to settle the difference amicably. If the parties fail to reach an agreement, the dispute will be referred to the Commercial Court of Le Havre.
